Big East Football: Motion to Dismiss West Virginia Lawsuit Denied

A judge in Mongolia Circuit Court has denied a motion by the Big East Conference to dismiss the lawsuit against them.

The lawsuit would enable West Virginia to leave the conference immediately and if the lawsuit was dismissed, the Mountaineers would be forced to stay in the conference for the mandatory 27-month waiting period.

As it stands now, they are not guaranteed to be able to leave the conference immediately, but it is looking more likely that it will be a possibility for West Virginia.

Another motion from the Big East asked to move the case to their home in Providence, Rhode Island. That motion was not ruled on by a judge as of yet, but one is expected by January 1.

If everything goes as planned for West Virginia, they will leave the conference on June 30, 2012 and join the Big XII a day later on July 1, 2012.

It is looking more and more like that is a distinct possibility for West Virginia. The Mountaineers have been begging to leave the conference since Syracuse and Pittsburgh jumped ship to the ACC and TCU decided to join the Big XII instead of the Big East.

With yesterday’s ruling, it is looking like they just might get their wish.

In the meantime, the Mountaineers will be representing the Big East in the Orange Bowl, while hoping the spring athletic season will be its last in the conference.

The Big East wants West Virginia to participate in all athletics until the suit has been resolved.

That resolution could be quicker than expected for West Virginia.
